What this Policy doesn’t cover

This Policy does not apply to the business, order or financial data that our subscribers upload into the Services about their own customers, orders, suppliers or operations (for example, order reports, settlement files, or other marketplace data uploaded for profit and loss analysis). In such cases, our subscribers remain the owner and controller of that data, and Profecom processes it strictly as a service provider/data processor on their behalf, for the purpose of generating the requested analysis. If you upload or provide us with any personal data about other individuals (such as your customers or employees), you confirm that you are legally authorised to do so and that you have obtained any consents required under applicable law.

2. Information We Collect

2.1 Information you provide to us directly

• Account & Identity Information: When you register for an account, we collect your name, email address, phone number, business/company name, and password.
• Billing & Payment Information: To process your subscription, we collect your billing details. Card numbers and other sensitive payment credentials are processed directly by our secure third-party payment gateways and are not stored on our servers.
• Marketplace and Business Data: Order reports, settlement files, payment data, return data, and other files you choose to upload or connect from platforms such as Meesho, Flipkart and Amazon, for the purpose of generating profit, loss and other business analysis.
• Communications: If you contact our support team, provide feedback, or participate in surveys, we collect your name, contact details, and the contents of your messages to us.

2.2 Information we collect automatically

• Device Information: We collect data about the device you use to access Profecom, including IP address, device type, operating system, and browser type.
• Usage Information: We track how you interact with the Platform, such as pages visited, features used, and the time and date of your visits.
• Cookies: We use cookies and similar tracking technologies to keep you securely logged in, remember your preferences, and understand Platform usage. You can configure your browser to refuse cookies, but some parts of the Platform may not function properly if you do.

• Integrations: If you choose to connect Profecom with a third-party marketplace or service (such as Meesho, Flipkart or Amazon, via API, file upload, or other integration), we may receive order, payment and related information from that service to power your analysis.

We do not sell or rent your personal information to anyone. We use the information we collect for the following purposes:

• To Provide and Maintain Our Services: to set up your account, process your subscription, generate profit/loss and other analysis from your uploaded or connected data, and ensure the Platform functions smoothly.
• For Security and Fraud Prevention: to verify accounts, monitor for suspicious or fraudulent activity, conduct audits, and prevent unauthorised access.
• To Improve the Platform: to troubleshoot bugs, analyse aggregated and de-identified usage trends, test new features, and develop better products.
• For Customer Support: to respond to your queries, resolve technical issues, and provide assistance.
• For Communication and Marketing: by providing your phone number and email, you consent to us contacting you via SMS, WhatsApp, voice call or email regarding account updates, invoices, security alerts and promotional communications about our products. Payment Gateways: Payment information transmitted on or through the Platform is protected by the encryption technology of our third-party payment gateways. You agree and consent to such sharing of information with these providers to process payments. While we use trusted partners, Profecom does not guarantee that transmission of payment-related information over the internet will be 100% secure, and to the maximum extent permitted by applicable law, Profecom shall not be liable for any unauthorised access, interception, or breach occurring on the systems of a third-party payment gateway or other service provider, except to the extent caused by our own gross negligence or wilful default.

Your Responsibility: You are responsible for keeping your account password confidential and for maintaining your own back-up copies of any business or financial data you upload to the Platform. We are not responsible for losses arising from your failure to secure your own login credentials or devices.

6. Protection Against Identity Theft and Phishing

We will never send you an email or call you asking for sensitive information such as your card details, bank account passwords, or one-time passwords (OTPs). Such requests are usually phishing attempts by unauthorised individuals and are illegal. If you receive a suspicious communication claiming to be from Profecom asking for this information, do not respond or click any links, and please report it to us immediately at info@profecom.in.

7. Data Retention and Hosting

We retain your personal data for as long as your account remains active or as needed to provide you the Services, and thereafter for such period as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Where data is no longer required for the purpose for which it was collected, and we are not otherwise required to retain it under law, we will take steps to delete or anonymise it.

We are an Indian entity, and your data is primarily hosted, processed and backed up on secure servers located within India.

8. Your Rights as a Data Principal

Under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules made thereunder, and subject to their applicable commencement and any exemptions provided under law, you (as a “Data Principal”) have the right to:

12. Limitation of Liability

While we implement reasonable security safeguards as described in this Policy, no system is completely secure. To the maximum extent permitted under applicable Indian law, Profecom's aggregate liability for any claim arising out of or relating to the processing of your personal data shall not exceed the amount you have paid to Profecom in the three (3) months preceding the event giving rise to such claim, except where such limitation is not permitted by applicable law or where the claim arises from our fraud or wilful misconduct.

13. Governing Law and Jurisdiction

This Privacy Policy is governed by the laws of India, including the Information Technology Act, 2000 and rules made thereunder, and the Digital Personal Data Protection Act, 2023, as applicable.
