We provide an easy-to-use online platform that helps e-commerce sellers on marketplaces such as Meesho, Flipkart and Amazon calculate profit and loss, track expenses, and generate business analysis reports. This Policy describes how we collect, use, process, share and protect your personal data. “Personal data” means information that relates to you and from which you can be identified, whether directly or indirectly.

By using the Platform or availing our Services, you agree to this Policy. If you do not agree to the terms of this Policy, please do not use our Platform and Services.

What this Policy doesn’t cover

This Policy does not apply to the business, order or financial data that our subscribers upload into the Services about their own customers, orders, suppliers or operations (for example, order reports, settlement files, or other marketplace data uploaded for profit and loss analysis). In such cases, our subscribers remain the owner and controller of that data, and Profecom processes it strictly as a service provider/data processor on their behalf, for the purpose of generating the requested analysis. If you upload or provide us with any personal data about other individuals (such as your customers or employees), you confirm that you are legally authorised to do so and that you have obtained any consents required under applicable law.

We work to protect your personal and business data from loss, misuse or unauthorised alteration using industry-recognised security safeguards, including encryption during data transmission, access controls, and secure data hosting, in line with the reasonable security practices and procedures required under the Information Technology Act, 2000 and the rules made thereunder.

Payment Gateways: Payment information transmitted on or through the Platform is protected by the encryption technology of our third-party payment gateways. You agree and consent to such sharing of information with these providers to process payments. While we use trusted partners, Profecom does not guarantee that transmission of payment-related information over the internet will be 100% secure, and to the maximum extent permitted by applicable law, Profecom shall not be liable for any unauthorised access, interception, or breach occurring on the systems of a third-party payment gateway or other service provider, except to the extent caused by our own gross negligence or wilful default.

Your Responsibility: You are responsible for keeping your account password confidential and for maintaining your own back-up copies of any business or financial data you upload to the Platform. We are not responsible for losses arising from your failure to secure your own login credentials or devices.

We will never send you an email or call you asking for sensitive information such as your card details, bank account passwords, or one-time passwords (OTPs). Such requests are usually phishing attempts by unauthorised individuals and are illegal. If you receive a suspicious communication claiming to be from Profecom asking for this information, do not respond or click any links, and please report it to us immediately at info@profecom.in.

We retain your personal data for as long as your account remains active or as needed to provide you the Services, and thereafter for such period as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Where data is no longer required for the purpose for which it was collected, and we are not otherwise required to retain it under law, we will take steps to delete or anonymise it.

All such names and logos remain the property of their respective owners.

While we implement reasonable security safeguards as described in this Policy, no system is completely secure. To the maximum extent permitted under applicable Indian law, Profecom's aggregate liability for any claim arising out of or relating to the processing of your personal data shall not exceed the amount you have paid to Profecom in the three (3) months preceding the event giving rise to such claim, except where such limitation is not permitted by applicable law or where the claim arises from our fraud or wilful misconduct.

13. Governing Law and Jurisdiction

This Privacy Policy is governed by the laws of India, including the Information Technology Act, 2000 and rules made thereunder, and the Digital Personal Data Protection Act, 2023, as applicable. By using our Platform, you agree that any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat.
